První soud s blogerem v ČR je u konce. Autor v diskuzi pod svým článkem na blogu označil jednoho z debatujících čtenářů za rasistu a puncovaného blbce. Čtenář jej zažaloval a soud vyhrál, ovšem pouze částečně. Nemá právo na odškodnění nebo stažení příspěvku, soudkyně navíc uvedla, že skutečně šlo o rasistický komentář.

V srpnu roku 2008 napsal Michal Matoušek na svůj blog u Respekt.cz článek s titulkem Z magických střípků šachu, tolerance i lásky. Pod na blogy nijak výjimečným textem se objevovaly komentáře, na které jsou čtenáři internetových diskuzí v podstatě zvyklí.

Jeden z komentářů (nyní nedustupný, byl odstraněn administrátorem, jeho kopie je např. zde), reagoval na článek komentářem začínajícím slovy: "Když si potomek, dejme tomu syn přivede domů přítele, feťačku, kriminálnici nebo echtovní cikánku, tak máte zaděláno na problémy do konce života..."

Matoušek na komentář reagoval ostrou obecnou i osobní kritikou, ve které použil kromě jiného i výrazů "vyblil pod text", "rasistický rypák" a přímo k osobě pana Martina Ondrejáta, autora zmíněného komentáře, pak "puncovaný blbec".

Soudkyně: jde o střet dvou základních lidských práv

Ondreját se cítil uražen a osočen z něčeho, čeho se nedopustil. Jelikož se nejednalo o blog, respektive diskuzi anonymní, podal na blogera Matouška trestní oznámení pro urážku na cti. Obžaloba nemusela dokazovat, že Michal Matoušek je skutečně autorem inkriminovaného komentáře, neboť tento fakt obhajoba nepopírala. Obhájce zakládal na tom, že v případě komentáře pana Matouška na adresu pana Ondrejáta šlo o "hodnotící soudy" na "veřejně přístupné, tzv. diskuzní stránce", tedy ne v samotném textu blogu.

Soudní přelíčení a jeho průběh ze svého pohledu popsali například Adam Javůrek (online.zurnalistika.cz) nebo Ivan Derer (zde a zde), který rovněž závěr soudu včetně rozsudku zaznamenal na videokameru.

Soudkyně Martina Štolbová vynesla 19.1. rozsudek: žalovaný je povinen se žalujícímu omluvit dopisem za "veřejné, sprosté a nevybíravé osočení nadávkami." Text je tedy výrazně kratší než žalobcem požadovaná omluva, která obsahovala také zmínku o "neoprávněném nařčení z rasismu", a soudkyně také rozhodla, že omluva nemusí být zveřejněna na blogu žalovaného. Nikdo nemá právo na uhrazení soudních výloh. Obě strany mají možnost se proti rozsudku odvolat.

Později soudkyně podotkla, že jde o typický příklad sporu, kde se do střetu dostávají právo na ochranu osobnosti a právo na svobodu slova. "Nelze říci, že by jednání na blogu nebo na internetu nepodléhalo právním předpisům," zdůraznila soudkyně. "Pokud se někdo na internetu nějak vyjadřuje nebo zasahuje do práv někoho jiného (...) musí počítat s možnými důsledky."

Podle soudkyně použité výrazy "překročily meze slušnosti v demokratické společnosti", uznala ale, že některá spojení, která žalobce použil, mohla vzbuzovat dojem diskriminace určité rasy. Na závěr soudkyně podotkla, že ze žalobou navrhovaného textu omluvy vyškrtla také slovo "upřímně", neboť vynucená omluva logicky není omluvou dobrovolnou a upřímnou.

Jak diskutovat na internetu?

Na internetových diskuzích platí určitá pravidla, ačkoli se může zdát, že tomu tak není. Jedním z obecných principů je vedle lidské slušnosti také tzv. netiketa. Její základní pravidlo, "Pamatuj, že na druhé straně je člověk," asi patří k těm nejčastěji porušovaným. Otázkou je, zda a jak má tyto sporné případy řešit soud.
